It is mutually agreed that there are no representations, promises, verbal understandings or agreements pertaining to this sale or this contract except those stated herein. The said motor vehicle is accepted by the buyer in its present condition and without guarantee. It has been purchased wholesale, for resale purposes only. The seller and seller’s agent will not be held liable for the vehicle in any respect after the fall of the hammer has pro-claimed the vehicle “sold”. With regard to auction services, the seller and buyer understand and agree as indicated by their participation in said auction to the following terms and conditions set forth in this agreement:

·         Year, Mileage, and Clear Title are guaranteed by the Seller.

·         ALL VEHICLES ARE SOLD “AS IS” WITH ALL FAULTS AND ARE NON-ARBITRATIONAL.

·         Seller reserves the right to retain ownership, possession and title until payment is made in full (including checks clearing buyer’s financial institution).

·         Auction makes no warranties and /or guarantees to the seller and buyer in respect to the vehicle offered and sold, nor does auction become involved in the actual sale transaction and process of title transfers.

·         Buyer agrees to make payment in full day of sale for all vehicles purchased.   

·         Non-payment day of sale will result in a $100.00 additional fee per vehicle. Including any checks or drafts returned to the Seller for any reason.

·         Both seller and buyer agree to pay auction any and all fees due as result of vehicle being offered and sale consummated. In the event the buyer cancels a sale the buyer shall still be responsible for any fee associated with that sale.

·         The seller and buyer hold auction harmless in absolute terms with respect to the vehicle and its purchase from the date of this sale.

·      Auction only acts in the capacity to provide the seller and buyer an atmosphere in which they may conduct their normal course of business.

·      Title Attached (T/A) vehicles may some time be offered and sold. In the event a buyer purchases a “T/A” vehicle the seller will provide a good and marketable title for said vehicle within 14 (fourteen) days from date of sale. Buyer shall not call the seller within that time.
